Privacy Policy

Your privacy is important to RubyHome Corporation (“Company,” “us,” “our,” or “we”) and we need to collect certain information to provide our services to you. Please read this Privacy Policy (“Privacy Policy”) to understand how we collect, use, and/or share your Personal Information (as defined below) when you visit and browse our website located at www.rubyhome.com and www.greatvancouverhomes.com (the “Site(s)”). Please note that this Privacy Policy does not govern any third-party websites and services that may be linked from the Site(s).

This Privacy Policy is incorporated by reference in our Terms of Service, and by using the Site(s) and/or submitting your information to search or create an account, you give express consent to all of the terms contained herein, as well as those provided in our Terms of Service. You may withdraw this consent by using the opt-out procedures described below.

1.     PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT.

When you visit and/or use our Site(s), we may collect your Device Information (as defined below), and/or Contact Information (as defined below). Collectively, Device Information and Contact Information are “Personal Information.

(a)   Device Information.

When you visit the Site(s), we automatically collect certain information that does not personally identify you but may uniquely identify the device you are using to visit the Site(s) (e.g., your computer, tablet, or smartphone) (“Device”), including information about your web browser, your Device manufacturer, your operating system and version, general location information, IP address, and your time zone and language settings. Additionally, as you browse the Site(s), we collect information about the individual web pages or products that you view on the Site(s), what websites or search terms referred you to the Site(s), and information about how you interact with the Site(s). We refer to this automatically-collected information as “Device Information.”

We and our Service Providers (as defined below) collect Device Information by setting cookies and other tracking technologies on the Site(s). For more information about cookies and other tracking technologies used on the Site(s), and your controls over their use, please review our Cookie Policy in Section 4 below.

How We May Use Your Device Information:

              i.        To help us screen for potential risk and fraud, in particular, by using your IP address.

             ii.        To measure, analyze, improve, and optimize the performance of our Site(s). 

            iii.        To show you ads about our products on third-party websites and applications.

(b)   Contact Information.

When you use the Site(s), there are several opportunities for you to interact with us, such as creating an account, contacting us via the Contact Form, or emailing us directly. When you do so, we may collect and use your name, email address, and any other information you voluntarily provide to us so that we can respond to you (“Contact Information”).

How We May Use Your Contact Information:

              i.        To receive communications from us regarding service offerings (Please refer to our Communications Policy below for additional information.)

             ii.        To respond to your questions and inquiries you send to us.

            iii.        If you are a subscriber, to send you occasional marketing newsletters and other email updates about us (“Newsletters”). For instructions on how to opt-out of receiving Newsletters, see below.

            iv.        To approve your comments and prevent spam if you are trying to comment on our blog articles.

             v.        To make you aware of research opportunities.

2.     COMMUNICATIONS POLICY.

When you provide your Contact Information, you are providing your express consent to receive communications from us. Communications from us may include telemarketing messages via email, landline phone, fax, cellular phone, text messages (including SMS and MMS), and notifications through any app that we may produce (“Communications”). We may use an automatic telephone dialing system which may use an artificial or pre-recorded voice or robotexts. Your carrier’s standard rates and charges may apply. Agreeing to receive Communications is not a condition of purchasing any property, goods, or services from us.

You represent and warrant that: (i) you are at least 18 years old; (ii) you live in the United States (or Canada, in such case, the Canadian consents below will apply); (iii) you are not registered on a national or statewide Do Not Call list; or you otherwise grant the Company a waiver to such registration to send you Communications; (iv) you are the account holder of, or have the required consent to provide the phone numbers and e-mail address provided; (v) the phone numbers and email addresses provided are accurate, and you will provide us notice if you release either such account to another.

(a)   Communication Frequency.

Communications we send to you will vary, as the individual salesperson working with you will determine the frequency.

(b)   Revoking Consent/Opting Out.

You may revoke your consent to receive Communications at any time. To stop receiving text messages, reply “STOP” to any of our texts. To stop receiving emails, click the “UNSUBSCRIBE” link when provided, or reply “UNSUBSCRIBE” to the email when the automated unsubscribe link is unavailable. Please allow up to fourteen (14) business days before you stop receiving Newsletters. You may also continue to receive emails unrelated to marketing. To stop receiving phone calls, please communicate that request to us through the phone or email us at [email protected] to update your communication preferences. We make commercially reasonable efforts to comply with any opt-out request from you, and we may send a final communication to you that confirms such request.

(c)   Canadian Residents.

In addition to the consent provided above, Canadian residents agree to the following compliance provisions, with respect to Canada’s Anti-Spam Legislation, Canada’s Personal Information Protection and Electronic Documents Act, and the Canadian Provincial Law, including Alberta’s Personal Information Protection Act, and Quebec’s Act respecting the protection of personal information in the private sector. You agree to the provisions governing the use and disclosures of Personal Information described in this Privacy Policy and you understand that Communication will continue until you opt-out, which will indicate that you are no longer considering real estate opportunities or the services we provide. Your Personal Information may also be transmitted to, used in, and stored in the United States.

3.     SHARING YOUR PERSONAL INFORMATION WITH THIRD PARTIES.

(a)   Service Providers.

Like most companies, we use tools from third party service providers to help us with some or all of our business through the Site(s) (“Service Providers”), and depending on the service we need, these Service Providers may have access to your Personal Information. For example, our third-party service vendors (such as mortgage lenders, insurance brokers, and title companies) may collect Personal Information from you, provided to them by you to help determine service eligibility. We also use Service Providers for the following purposes:

              i.        To host the Site(s).

             ii.        To deliver emails and newsletters.

            iii.        To help us conduct web analytics on the Site(s).

            iv.        To determine service eligibility.

We do not have direct control over how Service Providers use your Personal Information, and we cannot guarantee that our Service Providers will use your Personal Information as required in our contract with them. For this reason, we are not responsible for our Service Providers’ misuse of your Personal Information.

(b)   Business Transfers.

As we continue to develop our business, we may reorganize as a business entity, acquire entities, subsidiaries or business units, or enter into joint ventures with third parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of our assets are acquired, or we merge with a third-party, your information will likely be one of the transferred assets. You understand and agree that we reserve the right to transfer any information collected from you in the case of any such transfer. In such event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.

(c)   Legal.

We may disclose information you provide to respond to subpoenas, court orders, requests from authorities and other legal processes, and to establish/exercise our legal rights. We may also disclose your information to defend against legal claims when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. We may share your information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law.

4.     COOKIES AND OTHER TRACKING TECHNOLOGIES.

(a)   Tracking Technologies. We and our Service Providers use tracking technologies such as cookies, local storage, web beacons, pixel tags, tokens, widgets, etc. (“Tracking Technology”), to conduct analytics and to optimize the Site(s) functionality and performance. We may use both session cookies (which expire when you close out of your browser) and persistent cookies (which stay on your browser until deleted).

(b)   What are Cookies and Tracking Technologies?

Tracking Technologies are small data files that are stored on your Device by a website you visit. Commonly, companies use cookies on their websites to identify visitors, to remember visitors’ preferences, to better understand how visitors use and interact with the website, and to keep visitors logged into their accounts while they navigate the website. Cookies are either first-party cookies, which belong to the domain you are visiting, or third-party cookies, which are set by and belong to a different domain than the one that you’re currently visiting.

(c)   Your Control Over Cookies. In some cases, a third party might give you the ability to opt-out of receiving their cookies. Please review the third party’s privacy policy and/or cookie policy for more information. You can also control how cookies are used by updating your browser settings to accept or refuse all or certain types of cookies. If you choose to reject certain cookies, please note that the Site(s) and/or some of its features may not function properly.

5.     HOW IS MY PERSONAL INFORMATION USED FOR ANALYTICS? As an online business, it is important for us to know how users interact with our Site(s). We and our Service Providers will collect your Location Information and Device Information so that we can deliver our Site(s) to our users, measure, analyze, and improve performance of the Site(s), and to continually update and develop our Site(s). For example, we will use this information to fix any bugs or errors in the Site(s) and to determine if we need to support a new Device type for the Site(s).

6.     THIRD PARTIES AND THEIR POLICIES.

Throughout the Site(s), you may see links to third-party websites or applications. We are not responsible for the privacy practices of these third-party sites, and when accessing their sites, we encourage you to read their privacy policies.

7.     DATA RETENTION.

How long we store your Personal Information will depend on the purpose that we originally collected it. We will not retain Personal Information for longer than is necessary for our legitimate business interests or to comply with legal requirements. 8.     SECURITY.

The security of your Personal Information is important to us. We follow generally accepted industry standards to protect your information, both during transmission and once it is received. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. While no security system is completely secure, we and our Service Providers take appropriate security measures to protect against unauthorized access or disclosure of the information collected by us.

9.     MINORS.

The Site(s) are not directed to users under the age of 18 and we do not knowingly collect information from users under the age of 18. If we learn that we have received any type of information from a user under the age of 18, we will delete such information. 10.   ACCESSING, MANAGING, AND/OR UPDATING YOUR PERSONAL INFORMATION.

You can request to access, update, or correct some of your Personal Information by logging into your account and making the appropriate updates or by emailing us at [email protected]. If you request to have your Personal Information deactivated, we will have this information functionally deleted, and we will not sell, transfer, or use Personal Information relating to you in any way moving forward.

11.   California users' rights

We provide the following disclosures pursuant to Cal. Bus. & Prof. Code § 22575 - 22579.

We provide Visitors and Authorized Customers, including those claiming California residency, with information on how to exercise their respective disclosure options and choices pertaining to Personally Identifiable Information, such as the right to opt-out or unsubscribe, or opt-in for use of Personally Identifiable Information by third parties for marketing purposes. Accordingly, pursuant to the California Civil Code, we are not required to maintain or disclose a list of the third parties that have received Personally Identifiable Information for marketing purposes during the preceding year.

California residents wishing to request information about how to exercise their disclosure options and choices pertaining to third party disclosures, please send requests by mail to "Request for California Disclosure Choices" at the mailing address provided above. With all requests, please include your name, street address, city, state, zip code and e-mail address. We do not accept requests via telephone or fax. We are not responsible for failure to respond to incomplete or incorrectly labeled or submitted notices.

We do not abide by Do Not Track signals from a user's Internet browser. We make no representations concerning third parties that do not collect Personally Identifiable Information directly through our Site.

12.   FOR CUSTOMERS IN THE EUROPEAN UNION.

If you are a European resident, you have the right to access Personal Information we retain and to ask that your Personal Information be corrected, updated, or deleted. You additionally have the right to receive a copy of the Personal Information we have about you. If you would like to exercise these rights, please contact us by emailing [email protected].

Additionally, if you are a European resident, we note that we are processing your Personal Information in order to fulfill contracts we might have with you (for example if you make an order through the Site(s)), or otherwise to pursue our legitimate business interests, such as direct marketing, to prevent fraud, and to conduct analytics on the Site(s). Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States. We rely on model contractual clauses and/or the Privacy Shield certification for such transfers.

If you believe your rights under the General Data Protection Regulation (GDPR)have been violated, you may file a complaint with the supervisory authority of your country of residence. 13.   Anti-Discrimination Policy. We do not and cannot under the law, discriminate against users of the Site(s) for exercising any of their rights with regard to their Personal Information. Such forbidden discrimination includes, denying goods or services, charging different prices, or providing a different level or quality of service. However, we are, under the law, able to offer different services and rates if such differences are reasonably related to the value of the consumers' data.

14.   CHANGES.

We may update this Privacy Policy from time to time in order to reflect changes to our practices or for other operational, legal or regulatory reasons. If we decide to change this Privacy Policy, we will update the date at the top of this Privacy Policy.

15.   ENTIRE AGREEMENT

This Privacy Policy and the Terms of Service and any policies or operating rules posted by us on our site constitutes the entire agreement and understanding between you and us and govern your use of the Site(s), superseding any prior or contemporaneous agreements or communications, whether oral or written, between you and us (including, but not limited to, any prior versions).
